Kúpna zmluva medzi Predávajúcim a Kupujúcim sa považuje za uzavretú momentom, kedy Akceptácia Objednávky dôjde Kupujúcemu e-mailom.
2.10.
Kúpnou zmluvou sa Predávajúci zaväzuje, že za podmienok stanovených v týchto VOP Kupujúcemu odovzdá Tovar, ktorý je predmetom Kúpnej zmluvy, a prevedie na neho vlastnícke právo k Tovaru a Kupujúci sa zaväzuje, že Tovar prevezme a riadne a včas zaplatí Predávajúcemu kúpnu cenu podľa čl. 3 týchto VOP (ďalej len "Kúpna cena").
2.11.
Predávajúci si vyhradzuje právo neuskutočniť Akceptáciu Objednávky, ak v Internetovom obchode bola uvedená chybne cena, popis Tovaru alebo vložený nesprávny obrázok Tovaru, alebo ak Predávajúci z dôvodu vypredania alebo nedostupnosti Tovaru alebo z dôvodu, že sa výrazným spôsobom zmenila cena Tovaru zo strany výrobcu, dovozcu alebo dodávateľa Tovaru, z dôvodov vyššej moci alebo v prípade, ak ani pri vynaložení všetkého možného úsilia, ktoré možno od Predávajúceho spravodlivo požadovať, nie je schopný dodať Tovar Kupujúcemu v Kúpnej cene Tovaru uvedenej v okamihu uskutočnenia, resp. odoslania Objednávky, alebo dodať Tovar zodpovedajúci popisu Tovaru uvedenému v Internetovom obchode v okamihu uskutočnenia, resp. odoslania Objednávky alebo dodať Tovar v dodacej lehote určenej podľa týchto VOP, pokiaľ sa Predávajúci s Kupujúcim nedohodnú inak, napr. na náhradnom plnení alebo inej dodacej lehote. O neuskutočnení Akceptácie Objednávky Predávajúcim z dôvodov uvedených v predchádzajúcej vete bude Predávajúci bezodkladne informovať Kupujúceho emailom na e-mailovú adresu Kupujúceho uvedené/ú v Objednávke.
2.12.
Predávajúci je oprávnený odstúpiť od Kúpnej zmluvy uzavretej na základe Objednávky z dôvodu vypredania zásob Tovaru alebo nedostupnosti Tovaru, alebo ak výrobca, dovozca alebo dodávateľ Tovaru v Kúpnej zmluve prerušil výrobu Tovaru alebo vykonal tak závažné zmeny, ktoré znemožnili realizáciu splnenia povinností Predávajúceho vyplývajúcich z Kúpnej zmluvy alebo z dôvodov vyššej moci alebo ak ani pri vynaložení všetkého úsilia, ktoré možno od Predávajúceho spravodlivo požadovať, nie je schopný dodať Tovar Kupujúcemu v cene Tovaru dohodnutej v Kúpnej zmluve alebo dodať Tovar zodpovedajúci popisu Tovaru podľa Kúpnej zmluvy alebo dodať Tovar v dodacej lehote určenej podľa týchto VOP, pokiaľ sa Predávajúci s Kupujúcim nedohodnú inak, napr. na náhradnom plnení alebo inej dodacej lehote. Predávajúci je povinný o tejto skutočnosti bezodkladne informovať Kupujúceho a v lehote 14 dní odo dňa odoslania oznámenia o odstúpení od Kúpnej zmluvy vrátiť Kupujúcemu zaplatenú Kúpnu cenu alebo preddavok a zaplatené súvisiace poplatky rovnakým spôsobom, aký Kupujúci použil pri svojej platbe. Ak Predávajúci vráti Kupujúcemu Kúpnu cenu alebo preddavok a zaplatené súvisiace poplatky prevodom na bankový účet Kupujúceho, Predávajúci si splní povinnosť vrátenia Kúpnej ceny, preddavku a prípadných poplatkov momentom, keď zadá príkaz na úhradu v tejto výške svojej banke. Predávajúci nezodpovedá za to, ak vrátené peňažné prostriedky neboli pripísané na účet Kupujúceho vo vyššie uvedenej lehote z dôvodov, ktoré nemohol ovplyvniť, najmä v prípadoch pochybenia na strane banky Predávajúceho alebo banky Kupujúceho alebo zlyhania bankového systému. Tým nie je dotknuté právo Predávajúceho odstúpiť od Kúpnej zmluvy z dôvodov vyplývajúcich z platných právnych predpisov.
Translation - English 2.9.
A Purchase Contract between the Seller and Buyer shall be considered as concluded in the moment the Buyer receives notice of the Order being Accepted via e-mail.
2.10.
By concluding a Purchase Contract, the Seller undertakes to deliver the Goods subject to the Purchase Contract in accordance with the terms and conditions set forth in the present GSC and to transfer the ownership of the Goods to the Buyer; the Buyer undertakes to collect the Goods and to pay the Purchase Price in accordance with Art.3 of the present GSC, rightly and in a timely manner (hereinafter “Purchase Price”).
2.11.
The Seller reserves the right not to Accept an Order if the Goods price, the Goods description, or the picture of the Goods have been listed incorrectly; or if the Seller is unable to ship the Goods to the Buyer because of the Goods’ unavailability or if the Goods is out of stock, or because of a price change in the Goods’ pricing imposed by the Goods’ manufacturer, importer, or supplier, or caused by force majeure; or in the case that even after applying all commercially reasonable efforts the Seller is unable to deliver the Goods to the Buyer at the Purchase Price as listed on the e-shop at the moment of the Order’s realisation or submission, or unable to deliver the Goods true to the Goods’ description as listed on the E-shop at the moment of the Order’s realisation or submission, or unable to deliver the Goods within the delivery period as specified in the present GSC, unless the Seller and the Buyer agree otherwise, e.g. the Parties agree on a substitute shipment or a different delivery period. The Seller shall inform the Buyer about not Accepting an Order for any of the reasons listed above immediately by e-mail, sent to the Buyer’s e-mail address as listed in the Order.
2.12.
The Seller is entitled to terminate the Purchase Contract concluded on the basis of the Order on the grounds of the Goods’ unavailability or if the Goods is out of stock; or if the manufacturer, importer, or supplier of the Goods subject to the Purchase Contract has discontinued the Goods’ manufacture or has effected significant changes which render the fulfilment of the Seller’s obligations pursuant to the Purchase Contract impossible; or in the case of force majeure; or in the case that even after applying all commercially reasonable efforts the Seller is unable to ship the Goods to the Buyer at the Purchase Price listed in the Purchase Contract, or unable to deliver Goods true to the Good’s description as listed in the Purchase Contract, or unable to deliver the Goods within the shipment period as specified in the present GSC, unless the Seller and the Buyer agree otherwise, e.g. the Parties agree on a substitute shipment or a different delivery period. The Seller shall immediately notify the Buyer about this fact and within 14 days from sending notice of the Purchase Contract’s termination, the Seller shall refund the paid Purchase Price or advance payment and paid-for attendant charges by a payment method identical to that of the Buyer’s payment. Should the Seller be refunding the Purchase Price or advance payment and attendant charges to the Buyer by bank transfer to the Buyer’s bank account, the Seller shall fulfil the obligation of returning the Purchase Price or advance payment and attendant charges at the moment the Seller places the payment order at the Seller’s bank provider. The Seller shall not be liable if the amount to be refunded is not credited to the Buyer’s account within the abovementioned period for reasons outside of the Seller’s control, especially in case of misconduct by the Seller’s or the Buyer’s bank, or in case of failure of the banking system. This is without prejudice to the Seller’s right to withdraw from the Purchase Contract for reasons pursuant to the legal provisions in force.

Source text - Czech Ani nejlepší člověk není bez chyb; chyby mají i geniové. Martin byl vůbec nejlepší žák na škole, nosil samé jednotky. Ale jednu vadu měl, a ta byla nepřekonatelná. Neuměl počítat. Ne že by uměl počítat jen málo a špatně, anebo že by uměl počítat jen něco. Martin neuměl počítat nic. V primě sčítal s jistým sebezapřením dvě čísla. O dva roky později, v tercii, sčítal tři čísla. V kvartě, ve čtrnácti letech a tedy na prahu dospívání, sčítal čísla čtyři. Ale tento poznenáhlý, nicméně jistý vzestup jeho počtářských schopností, neměl dál pokračovat. V kvartě se pro Martina zastavila matematika úplně a byly marné všechny pokusy pochopit další různé manipulace s čísly, seč s písmenky, s nimiž se počítá také.
Když měl třídní profesor Sen, matematikář, obzvlášť dobrou náladu a chtěl sebe a třídu pobavit, nevykládal o svém domnělém čínském původu, kterým se rád bavil k ukrácení dlouhých a nudných hodin ve třídě, ale vyvolal Martina k tabuli a dal mu sečíst pět čísel. Tím opatřil dostatek obzvláštní zábavy na celou hodinu, a když pak zazvonilo, aniž se objevil na tabuli byť jen náznak nějakého součtu, odcházel ze třídy ve spokojené povyraženosti, jež mu stačila na celý týden.
Třídní profesor Sen poznal záhy, stejně jako celý profesorský sbor, že pokud jde o Martina, jsou jen dvě možné cesty.
Pánové,“ řekl matematikář Sen ve sborovně členům sboru. „Pokud jde o Martina, jsou jen dvě cesty. Buď mu dávat z počtů známku z milosti, a pak nanejvýš trojku, aby mu to nekazilo vyznamenání, anebo ho z počtů nechat propadnout, což by však značilo konec studií nejlepšího žáka našeho gymnázia.“
„Poslyšte,“ řekl tělocvikář. „Já tomu nechci ani věřit. To on vskutku neumí ani sečítat?“
„Kdež,“ řekl Sen, „ani sečíst pět čísel. S pomocí mou – s pomocí boží, sečte tři.“
„Pánové,“ řekl ředitel školy, který seděl v čele stolu. „Jako ředitel školy si rozhodně nevezmu na svědomí znemožnit tak nadanému žáku další studium jen proto, že v jednom předmětu vázne. Prosím vás,“ hodil rukou a zasmál se, až všem ztuhla krev, neboť ředitel byl velký a silný jako medvěd a hlas mel podle toho. „Prosím vás, když nebude umět počítat, nic se nestane.“
„Žel, stane,“ řekl matematikář Sen. „Kdo neumí počítat, je na tom v životě zle. To je zrovna tak, jakoby neuměl číst, vždyť on si jednou chudák jednou nespočte ani gáži!“
„No bože,“ mávl ředitel rukou, „tak řekne nějakému sousedu.“
„Nebo mu ji spočte žena,“ usmála se franštinářka.
„Nejde jen o gáži,“ řekl Sen. „V životě se počítají i jiné věci, třeba daně a všelijaká procenta, předplatné za noviny na měsíc… Ale rozhodně ho kvůli těm počtům nemůžeme vyloučit. Je už vlastně tím svým nedostatkem stejně postižen na celý život, tak co ho ještě trestat vyloučením ze školy..“
„Máte recht,“ kývl ředitel. „Dávejte mu známku z milosti. Ostatně,“ zasmál se na členy sboru, až všem ztuhla krev, „vždyť ono se vskutku nic nestane. Pánové, vy zapomínáte na jednu věc: že se z matematiky na reálných gymnáziích – co jsme prosím my, smím-li podotknout – povinně nematuruje. Vždyť ono tohle všechno, o čem tu rokujeme, může zůstat tajemstvím do nejdelší smrti.“
I stalo se, jak bylo správně rozhodnuto. Martin dostává po všechna léta na gymnáziu z matematiky známku z milosti – dvojku, aby se neřeklo. Byl nejlepší žák a z ostatních předmětů měl vskutku samé jedničky. Avšak po těchto dobrotivých letech, když Martin byl na prahu oktávy a měl ten školní rok maturovat, došlo k strašné věci, která všechny zasáhla jako blesk.
„Jsem z toho úplně pryč,“ zanaříkal profesor Sen ve sborovně a vytáhl nějaký papír. „Páni ještě nevědí o výnosu školní řady, který přišel minulou středu. Vzhledem ke stále rostoucímu významu přírodních věd, najmě matematiky, ve společnosti lidské, se počínaje letošním rokem stává i na reálných gymnáziích – a to jsme prosím právě my, páni, smím-li podotknout – maturita z matematiky povinnou. Stojí to tu,“ klepl do papíru, „Schwarz am Weiss, jak říkají Číňani. Jsem zničen.“
Ve sborovně zavládlo na chvíli mrtvé ticho.
„A to by,“ ozval se posléze tělocvikář, „to by nesvedl vskutku vypočítat nic, třeba nějakou hloupost?“
„Anebo odmocnit něco lehčího,“ nadhodila franštinářka.
„Kdež vypočítat a odmocnit,“ řekl Sen. „Ustrnul u těch pěti čísel v kvartě, u sčítání. Ale to ještě v těch číslech, aby páni nežili v klamných dojmech, nesmí být žádná devítka. Musí to být samá nižší čísla, nejlépe šestky a čtyřky nebo po pětkách.“
„Když jsme ho dovedli až sem,“ řekl ředitel rázně, „nehodíme ho přece na poslední chvíli přes palubu. Osm let mu dáváte známku, nemýlím-li se, dvojku, aby prošel a nezkazilo se mu vyznamenání, a najednou aby neudělal z počtu maturitu? Copak to jde? Co by nám k tomu řekla školní řada? Vždyť by nás ještě nařkla z nepravosti! Dáte mu k maturitě sečíst par těch nižších čísel a je to!“
„Ale když to nejde,“ řekl Sen. „Zaprvé se k maturitě dávají příklady s rovnicemi, zlomky, logaritmy, integrály – kdepak sčítání… A zadruhé, každý žák si u tabule tahá ze skříňky tři příklady a nikdo neví, co si vytáhne. Je to… jako na pouti.“
„Tak hleďte,“ zasmál se ředitel, až všem přesel mráz po zádech. „Naučte ho nějaký tři příklady nazpaměť. Teď je září, je tedy na to devět měsíců. Naučte ho taky tahat ze skřínky a je to.“
„Martine,“ řekl Sen po hodině matematiky, když vešli do kabinetu. „Devět měsíců je požehnaná doba, a vy se to naučíte nazpaměť. Taky tahat. Budu vás v tom trénovat.“
Translation - English Not even the best of people are perfect; geniuses, too, have their defects. Martin was the school’s best pupil and he was earning straight A’s. Yet he had one defect, and it was insurmountable: he couldn’t do maths. It wasn’t that he could only do a little and badly, nor that he could only do it somewhat. Martin could not do maths at all. In Year 1, aged 11, he would, with some self-abnegation, add up two numbers. Two years later, in Year 3, he would add up three numbers. In Year 4, aged fourteen and thus on the brink of adulthood, he would add up four numbers. Yet this slow but sure progress in numerical reasoning was not meant to go any further. Year 4 brought a complete halt to Martin’s mathematical aptitude
and further attempts to grasp the many other numerical – eventually, letter-bound – operations were all in vain.
When the form teacher Kip, who taught mathematics, happened to be in an exceptionally good mood and fancied to entertain the class as well as himself, he wouldn’t be spinning stories about his alleged Chinese ancestry, as he was fond of passing the long and tedious lessons – instead, he would call on Martin to stand by the blackboard with five numbers to add up. Thus he would provide an exceptional entertainment that would suffice for an entire session, and when the bell rang without a single trace of a sum on the blackboard, he would walk out of the classroom with an air of amusement that would last him a whole week.
The form teacher Kip soon knew, just as the rest of the teaching staff did, that as far as Martin was concerned, there were only two options.
“Gentlemen,” said Kip the maths teacher to the teaching staff in the staff room. “As far as Martin is concerned, there are only two options: we either give him a mark out of mercy, that is, at least a C as to keep his honours intact, or else we have him fail, which would however mean that our best pupil’s studies are finished.”
“Listen,” said the P.E. teacher. “I find it hard to believe. He really can’t even do sums?”
“I wish,” said Kip. “Not even five numbers. With my help – with God’s help, he can add up three.”
“Gentlemen,” said the headmaster. “As a headmaster, I cannot make myself accountable for ruining the studies of a pupil this talented just because he’s weak at a single subject. Please,” he waved his hand and laughed, which made everyone’s blood run cold, for the headmaster was bulky and strong like a bear and his voice was just as bear-like. “Oh please, there’s no harm in not knowing maths.”
“Regretfully,” said Kip the maths teacher, “there is. Whoever doesn’t know maths has a tough life ahead of him – it’s just like being illiterate. Poor lad won’t be able to count his own wages!”
“Oh well,” the headmaster waved his hand, “he could ask a neighbour.”
“Or his wife could do it for him,” smiled the French teacher.
“It’s not just wages,” said Kip. “Other things in life involve math as well, such as taxes and all kinds of percentages, the newspaper subscription fee... But we cannot by any means expel him because of maths. You see, this deficiency has him debilitated for life, so what good could come from punishing him by expulsion, too?”
“You’re right,” nodded the headmaster. “Give him the mark out of mercy. Anyway,” he laughed at the staff, which made everyone’s blood run cold, “it could hardly be of any consequence. Gentlemen, you are forgetting one fact: that in maintained grammar schools – such as ours, if I may add – a final exam in mathematics isn’t required for school-leaving qualification. And thus all we’ve been discussing here may be taken to the grave.”
And so it happened as they rightly agreed. For all these years in grammar school, Martin was getting a maths marking out of mercy – a B, as not to be suspicious. He was the best pupil and otherwise
did indeed earn straight A’s. However, after these kind years, just as Martin was entering Year 8 and about to take his final exams, a terrible thing happened, and it struck everyone like a lightning bolt.
“I am utterly dismayed,” cried Kip the maths teacher in the staff room and pulled out a piece of paper. “You gentlemen haven’t yet learned of the education board’s new regulation that arrived last Wednesday. Given the ever increasing – so the regulation says – significance of natural sciences in our society, especially of mathematics, a final exam in mathematics is now also required in maintained grammar schools – and that is, my dear gentlemen, exactly what we are, may I add – effective this year. It’s written right here,” he pointed to the paper, “ut clarum diem, as the Chinese say. I’m devastated.”
For a while the staff room remained dead silent.
“And couldn’t he,” finally spoke the P.E. teacher, “couldn’t he really do anything, not even a silly little sum?”
“Or a trivial square root,” suggested the French teacher.
“Sums and square roots – I wish! He froze at the five numbers in Year 4 sums. And just so you gentlemen aren’t kept in the dark, there must be no nines in the sum. It must only be smaller numbers, sixes and fours ideally, or fives.”
“When we’ve taken him this far,” said the headmaster resolutely, “we can’t throw him overboard now at last minute’s notice. You’ve been giving him marks for eight years – B’s, if I’m not mistaken – so that he’d pass with his honours intact, and now out of the blue he wouldn’t pass the final exam? Could this happen? What would the education board make of it? They’d accuse us of fraud! You’ll have him do sums with some of the smaller numbers and it’s done!”
“But that I can’t do,” said Kip. “First, the final exam consists of exercises with equations, fractions, logarithms, integrals – by far not sums... Second, each student picks three exercises from a box by the blackboard, and none of them know which one they’re about to pick. It’s... it’s like a traveling carnival.”
“Look,” laughed the headmaster and everyone felt a shiver down their spine. “Have him learn three exercises by heart. It’s September now, that gives you nine months. Have him also learn how to pick the right ones from the box and it’s done.”
“Martin,” said Kip after the maths class as they entered his office. “Nine months is time enough, and you’ll learn it by heart. How to pick from the box, too. I’ll be supervising you.”
