An apparent easement is an easement that is self-perpetuating and independent of human intervention. Flow of a stream is an example. An apparent easement is also an easement which can be enjoyed without an act by any person entitled to do so.

Zagadnienie służebności gruntowych jest wielowątkowe i bogate w problematy teoretyczne. Wśród licznych możliwych pól rozważań, a więc tematów monografii, wybrano rudymentarny, stanowiący o istocie instytucji oraz dotyczący trzonu jej regulacji w polskim prawie cywilnym. Temat pracy obejmuje więc zasadniczo służebności gruntowe unormowane w art. 285–295 k.c. Wymagały tego również rozsądne rozmiary monografii, a także reguła, w myśl której szerokość tematyczna opracowania naukowego powinna pozostawać w racjonalnej proporcji do głębi przeprowadzanych w nim rozważań. Z oczywistych zatem względów pominięto występujące niegdyś w Polsce, a współcześnie w innych krajach , tzw. służebności naturalne. Wynikają one, jak ich nazwa ma sugerować, „z natury rzeczy”, a więc z określonego położenia nieruchomości władnącej oraz obciążonej. Trafnie jednak zauważono, że w istocie prawa te powstają ex lege . Do takich służebności można zaliczyć na przykład służebność swobodnego spływu wody z gruntu położonego wyżej.
