A pro question is anything else... in other words, any question that requires knowledge or skills that are specialized (even slightly).
Another way to think of the difficulty levels is this: an easy question is one that deals with everyday conversation. A pro question is anything else.
When deciding between easy and pro, err on the side of pro. Most questions will be pro.
* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

"Can only ... seller when in state" — there appears to be something missing?
Assuming this document comes from the US (?), then 'in-state' would normally refer to being situated within the same state as [some other place] — remember that in the USA, although it is a federation, the states have a certain degree of autonomy, so it is conceivable that 'in-state' is an issue if it affects e.g. certain regulations, or might be being used as a delimiter of delivery distance etc. Only your wider context, and that missing text, might help to make it clearer.
As to how to render it in translation, that is going to depend, too, on the destination country, and in particular, its geographical organization.
