According to the Principles and Recommendations for Vital Statistics Systems, marital status is the status of individuals with respect to the marriage laws or customs of the country. It is recommended that the following categories of marital status be identified:
(a)single (never married);
(b)lawfully married;
(c)religious married, consensual union and customary union;
(d)widowed and not remarried;
(e)divorced and not remarried;
(f)married but legally separated.
Modifications of this classification which may need to be made to meet the special situations existing in some cultures must be based on first-hand knowledge of the local environment and customs.It should be mentioned, however, that in all cultures marital statuses ranging from legal to consensual unions are found in varying degrees and within that range unions may be monogamous or polygamous. The way people live together in the EU has significantly changed in the last decades. Marriage had long been considered as virtually the only way to form a family. This has changed and alternatives to marriage, like consensual unions and registered partnerships, have become more widespread. At the same time, births outside marriage have become more and more frequent.

Common-law marriage, also known as sui iuris (sui juris) marriage, informal marriage, marriage by habit and repute, or marriage in fact is a legal framework in a limited number of jurisdictions where a couple is legally considered married, without that couple having formally registered their relation as a civil or religious marriage. The original concept of a "common-law marriage" is a marriage that is considered valid by both partners, but has not been formally recorded with a state or religious registry, or celebrated in a formal religious service. In effect, the act of the couple representing themselves to others as being married, and organizing their relation as if they were married, acts as the evidence that they are married.

When a couple presents themselves as husband and wife and cohabitates for a substantial period of time they can be deemed married without the issuance of a marriage license or a ceremony. Usually the couple dwells together for at least a year and are in an agreement to become married at a later date. Every state does not recognize or permit common law marriages. However, in most cases if a couple becomes “married” by common law in another state sister states will recognize it as a marital situation.

Una encuesta publicada en el Periódico Primera Hora el 4 de mayo de 2007 sobre la Comunidad de P.R. de 2005 y cuya fuente es el Negociado del Censo de 2005, reflejó que hay un 34% de los hombres y un 28.6% de las mujeres que nunca se han casado. Los divorciados en el 2005 eran el 8.9% varones y en el 13.1%, mujeres. Las viudas en el 2005 eran el 10.4% de la población, y ellos el 2.8%. Dentro de estas cifras hay quienes mantienen una relación consensual, también conocida como concubinato, unión de hecho y/o matrimonio no formalizado. Estas relaciones han ido en aumento aunque algunas de ellas luego se formalizan al contraer matrimonio. No obstante, muchas parejas puertorriqueñas viven la realidad de estar unidos sentimentalmente a una pareja sin estar casados legalmente. En la edición de este mes, discutiremos algunos de los aspectos personales y patrimoniales al mantener una relación consensual o de concubinato.
