Spanish term

una incapacidad expedida por el Seguro Social

Spanish to English Bus/Financial Human Resources
Si durante el periodo de vacaciones el empleado llegara a tener una incapacidad expedida por el Seguro Social, estos días no impactarán su saldo de vacaciones.

Is this referring to disability benefit? And am a little unsure as to what 'estos dias' refers - days taken off as a result of disability?

Many thanks :)

Discussion

Lia Fail (X) May 14, 2007:
To my mind one is either sick or disabled, and the question of holidays doesn't arise with people who are not working - usually indefinitely and not as such entitled to holidays - becuase of a disability, which is viewed as more/less permanent.
Victoria Frazier May 14, 2007:
¿De dónde proviene el texto original? Si está hablando del Seguro Social en México IMSS, el término Social Security no es correcto.
Lydia De Jorge May 14, 2007:
What I interpret from the context is that if the employee becomes eligible and collects disability benefits from SS during their vacation, the vacation days will count as sick days instead and will not be deducted from accrued vacation time.
Lydia De Jorge May 14, 2007:
I'm a bit confused by some of the responses here and it could be because SS operates differnt in other countries. I would appreciate clarification (for my own knowledge).
Lydia De Jorge May 14, 2007:
'estos dias' refers to the days the employee is on vacation.

Gracias Cristina
disagree Lia Fail (X) : it's not dis/incapacity, which has connotations of long-term illness, not the illness that might affect hols of 1 month or so

Many thanks Lia... I see what you mean!!! and you're right! incapacity implies a long-term illness...
agree Silvia Brandon-Pérez : I disagree with Lia; social security gives benefits for short-term disability. Your answer is correct.

agree Patrick Weill : I live in Mexico where IMSS is social security. I like your answer.

sick leave

Sick leave is the time that a person spends away from work because of illness or injury. (BUSINESS)
ex. I have been on sick leave for seven months with depression.

sick leave
permiso or (Spain) baja feminine or (RPl) licencia feminine por enfermedad
Peer comment(s):

agree Marsha Way : Right, and "estos días" refers to the days the person was sick over vacation (which really sucks!)In Mexico at least, if you have "sick leave" during holiday or on a weekend, you get that many days off at the end of the break or weekend.

disability (certification) by the Social Security

I believe they are referring to a SS dictum. The days of disability, do not affect the regular vacation days.

--------------------------------------------------

There are regular benefits for sick days and the long term disability benefit that, if prolonged, it is paid by Social Security. These days should not affect vacation days.

agree Patrick Weill : You are right. I like "disability/incapacity certification"

a 8sick) certificate issued by teh SS

Looking at teh expression used in similar contexts (e.g. see end of page 3 in this PDF http://www.naalc.org/migrant/spanish/pdf/mgmexwpr_sp.pdf),

it seems quite clear that it's what the Spanish call a baja.

Si durante el periodo de vacaciones el empleado llegara a tener una incapacidad expedida por el Seguro Social, estos días no impactarán su saldo de vacaciones.

If an employee is issued with a (sick) certificate from the SS during his/her holidays, these days will not be counted as holidays.

OR

Vacation period days for which a (sick) certificate has been obtained from the SS will not be counted as holidays.

OOps!

Title: a (sick) certificate issued by the SS

--------------------------------------------------

In other words, if you can prove you were ill, by means of a proper cert obtained from the SS, then these days will not be counted as holiday - seems only fair and logical:-)

It's goy nothing to do with 'incapacity'. Refer to the PDF: it's a pregnant woman's right to be paid her salary when she is "certifiably" sick during her pregnancy.

--------------------------------------------------

The "estos dias" refers to the days of sick leave. If you took 30 days hols, and 4 of them were certified as sick, then after you came back, you would still be entitled to those 4 days.
