French term or phrase: se prévaloir d'un péril
I am translating a "signification d'un jugement d'orientation" in which the following language can be found: En application des dispositions de l’article R322-19 du Code des procédures civiles d’exécution, l’appel contre un jugement d’orientation est formé instruit et jugé selon la procédure à jour fixe sans toutefois que l’appelant n’ait à se prévaloir d’un péril.

claims to be at risk
Explanation:
I think this would be natural-sounding English here
I think the kind of matters that a defendant facing repossession might bring up would be homelessness (i.e. nowhere else to go) or disability, the needs of young children, elderly relatives etc. etc.
A corporate entity being evicted may have other issues but "at risk" seems to be generic enough.

disagree  Tony M: Wouldn't generally be terribly idiomatic in EN, and I don't believe it means that kind of physical 'danger', nor 'occurrence' — but I think this rather overlooks the sense of 'se prévaloir de'

disagree  Daryo: that's streeeeching the meaning of 'se prévaloir de' .... a bit too much

Le jugement d'orientation = decision of the judge to authorise the forced sale of debtor's property

there is no need for the debtor to invoke any kind of emergency situation / being in distress (to claim being "in danger" in the sense of being in a particularly difficult personal situation) to have the right to appeal this "jugement d'orientation"

neutral  AllegroTrans: Yes, precisely with regards context but an appellant "in distress" somehow jars, isn't this more likely to concern matters such as homelessness? I think it could be reworded

-> I don't like much "distress" either - it's more a prompt for better ideas OTOH "emergency situation" should be right?
