You had a work-related injury back in September 2016 which placed you on modified work, which we accommodated for some time. On January 10th, your manager let you know (and notified our Workers Compensation carrier regarding your claim) that they were sending you home since it had been 4 months since your original injury and according to the notifications from MedStop you weren’t seeing any improvement, even working within the restrictions and the company is worried that any work at this point may be contributing to your inability to get better.
As such, you are qualified under state and federal law to take time off under family and medical leave act (FMLA), effective 1/10/17. Please note that state and federal family and medical leave run concurrently. You are entitled to up to twelve (12) weeks of FMLA leave in a 12-month period. All such leaves are unpaid leaves, and may be taken all at once or on an as-needed basis.
You may also be eligible for state Disability or Paid Family Leave (a wage replacement program), which you can apply for through the EDD (see attached pamphlet with information on how to apply), as well as wage replacement through your worker’s comp claim. Any Worker’s Comp and/or PFL benefits and sick leave pay will be coordinated so that your leave payments to not exceed your normal rate of pay.
From 1/10/17 through today’s date you have used zero (120) hours of FMLA in and thus the total remaining FMLA leave available to you is 360 hours.
According to the information received from your last visit on 1/19/17, MedStop is recommending you see a specialist, and your next visit is scheduled on 2/23/17. If we receive notice from your doctor at the time of that visit that the modification is still required then we will have to keep you on leave. If at that time (or anytime prior) he releases your limitation, we will expect you to return to work the next day.
During your leave, you are entitled to take any accrued and unused vacation and sick hours. As of your 1/20/17 paycheck, you had 34.4 vacation hours and 8.6 sick hours available.
Under state and federal family and medical leave, you are eligible for continued health benefits for a maximum of twelve (12) weeks. We will deduct your portion of the January insurance premium from any vacation and sick time pay you may have on your 2/3/17 paycheck, and will use any sick/vacation necessary to cover February’s premium’s on the 2/17/17 paycheck. If/when your vacation and sick hours are exhausted you will need to remit your portion of the premium to The Spice Hunter. If/when that happens, we will contact you to let you know the payment amount and frequency if necessary.

Usted tuvo una lesión relacionada con el trabajo en septiembre de 2016, la cual le ha colocado en una situación de trabajo modificado la cual hemos acomodado para usted por algún tiempo. En el caso que sus horas de vacaciones y por enfermedad hayan sido utilizadas, necesitará enviar su porción de la prima a Spice Hunter. Nos pondremos en contacto con usted para indicarle el importe de pago cuando esto sea necesario.

The Company has received notification from MedStop which indicates you will require time off from work due to a crush and cut finger, which happened from work related tasks. Unfortunately at this time the company is unable to accommodate modified work, as the limitations listed by your doctor are too much for the nature and scope of available work.
However, you are qualified under state and federal law to take time off under family and medical leave act (FMLA), effective as of the date of injury, 1/9/2017. Please note that state and federal family and medical leave run concurrently. You are entitled to up to twelve (12) weeks of FMLA leave in a 12-month period. All such leaves are unpaid leaves, and may be taken all at once or on an as-needed basis.

We will continue to receive notices from MedStop and from the Traveler’s Insurance Worker’s Compensation nurse coordinator your doctor as to your recovery and estimated date of return. If at any time your doctor releases your limitation to work, please let us know and we will expect you to return to work the next day.
During your leave, you are entitled to take any accrued and unused vacation and sick hours. As of your 1/20/2017 paycheck, you had 13.20 vacation hours and 45.34 sick hours accrued. You do not accrue more vacation or sick time while you are out on leave.

We will deduct your portion of the insurance premium from any sick time and/or vacation pay you may have. If/when your vacation and sick hours are exhausted you will need to remit your portion of the premium to The Spice Hunter.
